Has your life insurance, property insurance, or critical illness insurance claim been denied? If so, we are here to help.

Insurance companies do not make money by paying out claims. They look for any opportunity to deny coverage, such as allegations of misrepresentation, pre-existing history exclusions and non-compliance with the policy conditions.

You do not have to accept “No” for an answer. Your insurance company owes you a duty of good faith in handling your claim. If your claim has been denied, the insurance company cannot act arbitrarily and must have a valid reason for denying coverage.

We have seen insurance companies deny claims when they have no basis for doing so, or they undervalue the claim. The insurance litigators at Pinto Shekib LLP understand insurance policies and the claims process, as we were previously lawyers to some of Canada’s largest insurance companies. We can help you get the compensation that you deserve. Contact Pinto Shekib LLP to schedule a free consultation.

Whether you have a personal injury claim, long term disability claim or property damage claim, it is important to seek legal advice before agreeing to an Examination Under Oath (“EUO”) or a Statement.

An EUO takes place in a formal setting with the attendance of a court reporter. You give evidence under oath, while the entire process is recorded and transcribed. The questions must be answered honestly and carefully. It is important to remember that not all questions are allowed, and many people do not know how to differentiate between the questions they should answer and those that should be refused. Statements are largely similar to an EUO; however, they are not completed in front of a court reporter. They may nevertheless be recorded and used against you.

Claim representatives can use your Statement or EUO to deny or reduce your claim. This is why it is important for you to contact us and seek appropriate legal advice before giving a Statement. Let us guide you through the claims process. Contact Pinto Shekib LLP to schedule a free consultation.
